NOTICE is hereby given that the Board of Supervisors of Birmingham Township, Chester County (“the Board”), will conduct a public hearing on Monday, February 3, 2020, at 6:30 p.m., in the Birmingham Township Municipal Building, 1040 West Street Road, West Chester, Pennsylvania, to consider the conditional use application of Otto’s Imported Cars, Ltd., the operator of the Otto’s BMW automobile dealership located at 1275 Wilmington Pike, West Chester, PA 19382, also known as Chester County Tax Parcel No. 65-4-78.3 (the “Property”). The Property is owned by MLV Family, L.P. and has been approved for use as an automobile dealership pursuant to Section 122-51.8.A(2) of the Birmingham Township Zoning Ordinance. Applicant previously received conditional use approval pursuant to Section 122-51.9.G to allow curbs, parking, light standards and a retaining wall in the 80-foot rear yard setback in a conditional use Decision and Order dated May 16, 2011. Applicant now seeks the Board’s approval to amend the May 16, 2011 Decision and Order to allow 19 two level car racks over top of existing macadam in the rear of the dealership building that is currently used for 21 employee parking spaces. The Property is located in the C-2A Limited Highway Commercial District and contains 6.8 acres.
