On August 2, 2004, Dilworthtown Partners received a modification to the November 17, 2003 Conditional Use Approval for multiple uses on a single lot for the property located at 275 Brinton’s Bridge Road, currently known as the Country Store. 
The property can be used for the following three uses, but no others:
A retail store not to exceed 780 square feet which sells private label and unique food products as well as seasonal gift      items and kitchen and dining related accessory items.
A colonial inn for eating and drinking not to exceed 3,720 square feet.
One apartment on the second floor not to exceed 610 square feet.
The hours of operation for the retail store shall be limited to 9 a.m. to 11 p.m. and the take-out facility at the Country Store shall be limited to 10 a.m. to 10 p.m.
The seating capacity for the Country Store Colonial Inn shall not exceed 75 seats inside with the final number of seats to be approved by the Supervisors during the land development process.
The Country Store Colonial Inn may have an outdoor patio to the rear of the building with tables for outdoor dining; provided, however, that the total number of customers inside and outside of the Colonial Inn may not exceed 75 people, or such lesser number as approved by the Board during the land development process.
If the Country Store Colonial Inn is open for lunch, the Dilworthtown Inn shall remain closed, except that the Dilworthtown Inn may be open for lunch on holidays and for occasional, private functions (such as funeral, charitable or political events) which do not utilize 100 percent of the seating capacity of the Dilworthtown Inn and which must be concluded by 5:30 p.m.
Dilworthtown Partners shall rely on a reservation policy at the Country Store Colonial Inn to control the volume of customers, but shall not be precluded from seating walk-in customers.
After the Country Store retail store or Colonial Inn are open for business, if the Board, in its sole discretion, determines that valet parking at the Dilworthtown Inn is necessary, it shall send written notice to Dilworthtown Partners to institute valet parking. If the valet parking does not alleviate congestion, or the need for additional parking, the Supervisors may require Dilworthtown Partners to install some or all of the 58 reserved parking spaces on the Inn Keeper’s Kitchen Parcel.

BENNIGAN’S Grill & TAVERN
On August 2, 2004, Bennigan’s Grill & Tavern received approval for a modification of the conditional use decision for the Shoppes @ Dilworthtown to allow for curb-side take-out service. One parking space on the side of the restaurant will be designated for the take-out service. Three small directional signs will be installed to direct traffic to the designated take-out parking area.  

BIRMINGHAM DEVCO
Birmingham Devco, developer for the Shoppes @ Dilworthtown Crossing Center, has proposed a zoning ordinance amendment change to allow additional signage in the Highway Commercial District by conditional use of the Board of Supervisors, subject to specified standards, including:
The property must contain a combination of uses.
The entire tract on which the uses to be served by the sign is a minimum of 25 acres.
The property has frontage along a major arterial street in excess of 150 percent of the required footage for the C-1 district.
The allowed signage is not sufficient to properly identify the combination of uses.
The proposed signs will not interfere with the safe operation of roads and neighboring intersections.
Birmingham Devco is looking to erect a second sign along Rt. 202 for the Shoppes @ Dilworthtown Crossing Shopping Center for the stores in the back of the shopping center that are not listed on the existing sign. Birmingham Devco had submitted an application to the Zoning Hearing Board for a variance, but the application had been denied. A hearing before the Board of Supervisors on the zoning ordinance amendment was held on Tuesday, September 7th. A decision by the Board of Supervisors on the application is pending.

GENERAL SALES
On August 2, 2004, General Sales Company received Land Development Plan Approval for two buildings totaling approximately 6,200 square feet and an expansion of the existing parking lot at the General Sales automobile dealership located at 1265 Wilmington Pike to satisfy its sales and service contractual agreements with SAAB, Inc. USA Division of General Motors. 

PHP ENTERPRISES
PHP Enterprises has submitted a conditional use application to build a car wash and doggie day care facility at 
1313 Wilmington Pike. Hearings were held on the application on July 12th and August 23rd. The next 
hearing is scheduled for Monday, October 25th, at 7:30 p.m.
